Konvention gegen Rassismus (ICERD)

Internationales Übereinkommen zur Beseitigung jeder Form von rassistischer Diskriminierung [am 15.06.1969 in Deutschland in Kraft getreten; Bundesgesetzblatt 1969, Teil II, S. 962]*

International Convention on the Elimination of all Forms of Racial Discrimination (ICERD)  [General Assembly resolution 2106 (XX) of 21 December 1965; entry into force 4 January 1969]

* Das Deutsche Institut für Menschenrechte spricht sich gegen die Verwendung des Begriffs „Rasse“ in Gesetzestexten aus und empfiehlt, dass er durch eine alternative Formulierung zum Schutz vor rassistischer Diskriminierung ersetzt wird.

Artikel 5

Im Einklang mit den in Artikel 2 niedergelegten grundsätzlichen Verpflichtungen werden die Vertragsstaaten die Rassendiskriminierung in jeder Form verbieten und beseitigen und das Recht jedes einzelnen, ohne Unterschied der Rasse, der Hautfarbe, des nationalen Ursprungs oder des Volkstums, auf Gleichheit vor dem Gesetz gewährleisten; dies gilt insbesondere für folgende Rechte:

a) das Recht auf Gleichbehandlung vor den Gerichten und allen sonstigen Organen der Rechtspflege,

b) das Recht auf Sicherheit der Person und auf staatlichen Schutz gegen Gewalttätigkeit oder Körperverletzung, gleichviel ob sie von Staatsbediensteten oder von irgendeiner Person, Gruppe oder Einrichtung verübt werden,

c) die politischen Rechte, insbesondere das aktive und passive Wahlrecht auf der Grundlage allgemeiner und gleicher Wahlen, das Recht auf Beteiligung an der Regierung und an der Führung der öffentlichen Angelegenheiten auf jeder Ebene sowie das Recht auf gleichberechtigten Zugang zum öffentlichen Dienst,

d) sonstige Bürgerrechte, insbesondere

i) das Recht auf Bewegungsfreiheit und freie Wahl des Aufenthaltsortes innerhalb der Staatsgrenzen,

ii) das Recht, jedes Land einschließlich des eigenen zu verlassen und in das eigene Land zurückzukehren,

iii) das Recht auf die Staatsangehörigkeit,

iv) das Recht auf Ehe und auf freie Wahl des Ehegatten,

v) das Recht, allein oder in Verbindung mit anderen Vermögen als Eigentum zu besitzen,

vi) das Recht zu erben,

vii) das Recht auf Gedanken-, Gewissens- und Religionsfreiheit,

viii) das Recht auf Meinungsfreiheit und freie Meinungsäußerung,

ix) das Recht, sich friedlich zu versammeln und friedliche Vereinigungen zu bilden,

e) wirtschaftliche, soziale und kulturelle Rechte, insbesondere

i) das Recht auf Arbeit, auf die freie Wahl des Arbeitsplatzes, auf gerechte und befriedigende Arbeitsbedingungen, auf Schutz gegen Arbeitslosigkeit, auf gleiches Entgelt für gleiche Arbeit, auf gerechte und befriedigende Entlohnung,

ii) das Recht, Gewerkschaften zu bilden und ihnen beizutreten,

iii) das Recht auf Wohnung,

iv) das Recht auf öffentliche Gesundheitsfürsorge, ärztliche Betreuung, soziale Sicherheit und soziale Dienstleistungen,

v) das Recht auf Erziehung und Ausbildung,

vi) das Recht auf eine gleichberechtigte Teilnahme an kulturellen Tätigkeiten,

f) das Recht auf Zugang zu jedem Ort oder Dienst, der für die Benutzung durch die Öffentlichkeit vorgesehen ist, wie Verkehrsmittel, Hotels, Gaststätten, Cafés, Theater und Parks.

Article 5

In compliance with the fundamental obligations laid down in article 2 of this Convention, States Parties undertake to prohibit and to eliminate racial discrimination in all its forms and to guarantee the right of everyone, without distinction as to race, colour, or national or ethnic origin, to equality before the law, notably in the enjoyment of the following rights:

(a) The right to equal treatment before the tribunals and all other organs administering justice;

(b) The right to security of person and protection by the State against violence or bodily harm, whether inflicted by government officials or by any individual group or institution;

(c) Political rights, in particular the right to participate in elections-to vote and to stand for election-on the basis of universal and equal suffrage, to take part in the Government as well as in the conduct of public affairs at any level and to have equal access to public service;

(d) Other civil rights, in particular:

(i) The right to freedom of movement and residence within the border of the State;

(ii) The right to leave any country, including one's own, and to return to one's country;

(iii) The right to nationality;

(iv) The right to marriage and choice of spouse;

(v) The right to own property alone as well as in association with others;

(vi) The right to inherit;

(vii) The right to freedom of thought, conscience and religion;

(viii) The right to freedom of opinion and expression;

(ix) The right to freedom of peaceful assembly and association;

(e) Economic, social and cultural rights, in particular:

(i) The rights to work, to free choice of employment, to just and favourable conditions of work, to protection against unemployment, to equal pay for equal work, to just and favourable remuneration;

(ii) The right to form and join trade unions;

(iii) The right to housing;

(iv) The right to public health, medical care, social security and social services;

(v) The right to education and training;

(vi) The right to equal participation in cultural activities;

(f) The right of access to any place or service intended for use by the general public, such as transport hotels, restaurants, cafes, theatres and parks.
