How the Child's Right to Participation Can be Promoted in German Development Cooperation

The Study illustrates measures of German development cooperation (DC) for the promotion of the child’s right to participation, outlines the human rights standards for child participation and concludes with recommendations for German development policy. It is based on a qualitative, interdisciplinary research, including interviews with children and youth as well as stakeholders of DC in Guatemala, Kenia, Kirgizstan and Serbia.

Children’s and young people’s rights in development cooperation

Germany and virtually all the countries partaking in German development cooperation have ratified the UNCRC and are committed to implementing it. Nevertheless, many states are still not honouring their commitments regarding human and children’s rights. In consequence millions of young people are left without an opportunity to exercise their rights.
 
The want of practical knowledge regarding children’s and young people’s right called for this methodical guide to practical implementation. The United Nations’ human rights protection system forms the basis to this guide, along with associated instruments of the United Nations, especially the work of the United Nations Committee on the Rights of the Child. The methodical guide also incorporates experience gained during a pilot phase with multipliers in Kirgizstan, Guatemala, and Burkina Faso in 2013/14. It is a suitable handout for two and a half day workshops on children’s and young people’s rights, but may also be used as toolbox for human and children’s rights education within the various sector focuses of German development cooperation.

The key source of explanation and interpretation of the UN human rights conventions are the General Comments of the UN treaty bodies. In order to make the essential content of the General Comments more widely available, the Institute has summarised the General Comments No. 1, 2, 10 and 12 and has made suggestions for their use by development practitioners. This publication on General Comment No. 10 provides guidance in dealing with children in conflict with the law, who are children, alleged as or accused of having committed a criminal offence and those who have been convicted with infringing criminal law.
